These general conditions of sale are concluded between OPPIDUM, SAS with a capital of 4 000 € registered with the RCS of Albi under the number 833710361, having its seat Prat de La Borie, 81140 Puycelsi, and on the other hand any person who made a purchase on the website http://www.oppidum-france.com, hereinafter referred to as "the customer". Any purchase on the site www.oppidum-france.com automatically implies acceptance of all these conditions which the customer acknowledges having read prior to his order.

 

Article 1: Buyer's capacity

The Customer who buys on the site declares to be legally able to commit on these general conditions of sale.

 

Article 2: Price

All prices presented on the site are inclusive of all taxes. The prices of the products are indicated in euros. OPPIDUM reserves the right to change its prices without notice and the prices applied to the Customer correspond to those posted on the site at the time of its order. The goods remain the integral property of OPPIDUM until the receipt of the total amount due paid by the Customer.

 

Article 3: Presentation of articles

OPPIDUM strives to present and describe its articles as accurately as possible. 

 

Article 4: Order

The order is validated once the payment has been accepted by OPPIDUM.

OPPIDUM reserves the right to refuse an order if the Customer already has a dispute with OPPIDUM or if OPPIDUM considers that the Customer has a risk of default. OPPIDUM reserves the right to ask its Customer for further information if it deems it necessary. Without Customer response within 5 days of OPPIDUM's request, the order and payment are cancelled.

OPPIDUM undertakes to honour orders received and validated, only within the limits of available stocks.

 

Article 5 : Deliveries in Metropolitan France 

Any orders placed and posted from Monday to Friday (except public holidays) are shipped within 48h (in working days) following the order time.

Orders placed on Saturdays and Sundays will be shipped within 48h of the following Monday.

Orders placed on public holidays will be shipped within 48h from the next business day.

Only one method of delivery is offered: Colissimo.

Article 6: Overseas & International deliveries 

Any orders placed and posted from Monday to Friday (except public holidays) are shipped within 48h (in working days) following the order time.

Only one method of delivery is offered: Colissimo.

Outside the European Union, customs or import taxes can be added to the price of our products and remain the responsibility of the Customer. It is therefore the Customer's responsibility to inquire about their amount from their local customs office.

The shipping costs are the responsibility of the Customer and vary according to the place of destination and the weight of the parcel: all the details of the costs and deadlines by geographical area are on the page Deliveries & Returns.

 

Article 7: Payment

A. The different methods of payment

Once the customer validates his order, he accepts the entire terms and conditions of sale. The customer pays on the website www.oppidum-france.com:

- by credit card (CB, Visa or Mastercard) via the secure Stripe payment platform;

- by the Paypal platform; and/or

- by means of a purchase voucher.

 

B. 3D Secure payment 

Your order can be subject to a 3D Secure check. 3D Secure is an authentication payment system that ensures optimum security when you shop online. Upon payment, your bank verifies the identity of the cardholder before validating the transaction.

How a 3D Secure check works
After you have validated your bank details, you are transferred to the site of your banking. In the 3D Secure window that appears, the authentication process to follow is unique to each bank. You may be asked:

C. Verification of payments

Article 8: Secure payment - Protection of bank transactions

Article 10 : Return, Exchange 

The Customer has a period of 14 days from the day of receipt of his order to exercise his right of withdrawal without giving any reason.

In the event of withdrawal by the Customer, OPPIDUM shall reimburse the Customer the amount of the order, including delivery costs (with the exception of additional costs arising from the fact that the Customer has chosen, where applicable, a more expensive delivery method than the standard delivery method proposed by OPPIDUM), no later than fourteen days from the date on which OPPIDUM is informed of the Customer's decision to withdraw. 

OPPIDUM may defer reimbursement until receipt of returned products or until the customer has provided proof of shipment of the products, whichever date is the first of these.

When the order was accompanied by a gift offered to the customer under conditions – for example, gift offered only if a minimum order amount was reached – and the customer no longer fulfils the conditions necessary to obtain the gift as a result of Exercise of the right of withdrawal by the customer, the gift must be returned to OPPIDUM with the returned products and OPPIDUM may defer the refund until receipt of the gift or until the customer has provided proof of shipment of the gift, the date Restraint being that of the first of these facts.

OPPIDUM will make the refund using the same payment method as the one used for the initial transaction, unless the Customer expressly agrees to a different method and such refund does not incur any costs for OPPIDUM. 

The customer will have to send back or return the property to OPPIDUM, Prat de la Borie, 81140 Puycelsi, no later than fourteen days after the customer has communicated his decision of withdrawal. This period is deemed to be respected if the customer returns the property before the expiration of the fourteen-day period.

The customer will be responsible for the direct costs of returning the property.

OPPIDUM advises the Customer to choose a mode of transport with a tracking number. Without a tracking number, OPPIDUM will not accept any claim. 

The liability of the Client is only committed in respect of the depreciation of the property resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the property.

Orders made on the OPPIDUM website may not be returned or exchanged in the shops where the OPPIDUM products are distributed.

 

Article 11: Vouchers 

The purchase vouchers sent by OPPIDUM in Exchange for a return or purchased by the customer are usable for 1 year on all the products offered on the website www.oppidum-Francecom. Purchase vouchers are not combinable with each other or with promotional codes. Gift vouchers purchased on the OPPIDUM website may not give rise to a cash refund.

 

Article 12: Promotional codes 

Promotional codes apply only to undeliverable base prices. Promotional codes are not cumulative between them or with purchase vouchers. Promotional codes can be used 1 time per customer account unless otherwise instructed by OPPIDUM. These codes are not refundable during an exchange.

 

Article 13: Intellectual Property

Article 15: Legal Guarantee

The products sold on the website www.oppidum-France. com are subject to the legal guarantee of conformity set out in articles L. 217-4 et seq. of the consumer code and the guarantee against latent defects set out in articles 1641 and following of the civil code.

15.1 Legal guarantee of conformity

Article L. 217-4 of the Consumer Code : The seller delivers a property in accordance with the contract and responds to defects of conformity existing at the time of issuance. 15.2 Warranty of defects of the thing sold

Article 1641 of the civil Code: The seller is bound by the guarantee because of the hidden defects of the thing sold which make it unfit for the use to which it is intended, such use that the purchaser would not have acquired it, or would have given only a lesser price if he had Known. Article 1648 of the civil Code: The action resulting from the redhibitory defects must be brought by the purchaser within two years after the discovery of the defect.

When acting as a legal guarantee of conformity, the customer:

-Has a period of two years from the issuance of the property to act;
-May choose between the repair or replacement of the property, subject to the cost conditions laid down in article L. 217-9 of the consumer Code;
-is exempt from reporting evidence of the existence of a failure to comply with the property during the twenty-four months following the issuance of the property.

The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted. 

The customer may decide to implement the guarantee against the hidden defects of the thing sold within the meaning of article 1641 of the Civil Code and may in this case choose between the resolution of the sale or a reduction of the selling price in accordance with article 1644 of Civil Code.
